"Delegate" is the brand. The legal entity providing the service is Trydelegate, LLC (a Pennsylvania limited liability company). Throughout this policy, "we", "us", and "our" refer to Trydelegate, LLC. This policy explains what we collect, why, and how we use it.
What we collect
When you use Delegate, we collect:
- Account information you provide: name, business name, email, phone number, billing address.
- Customer interaction data: the SMS messages and voice calls your AI agent processes on your behalf — including phone numbers, message content, call transcripts, timestamps, and outcomes.
- Usage data: number of conversations, calls, bookings, and other metrics tied to your account.
- Technical data: IP address, browser type, device identifiers, log data when you access the platform.
- Payment data: handled by our payment processors (Mercury, Square). We do not store full card numbers on our servers.
Why we collect it
- To deliver the AI agent service you've contracted us for — without conversation data, the agent cannot respond to your customers.
- To bill you accurately based on your tier and usage.
- To improve agent quality. Conversation transcripts may be used in aggregate to improve prompt templates and routing logic. We do not sell or share individual conversation content with third parties.
- To comply with legal obligations (A2P 10DLC compliance, CAN-SPAM, TCPA, tax reporting).
- To communicate with you about your account, product updates, and billing.
Who we share it with
We share data with the following processors strictly to deliver the service:
- Twilio / Bandwidth (SMS + voice carrier)
- Anthropic (AI model provider — Claude)
- Vapi (voice agent infrastructure)
- ElevenLabs (text-to-speech)
- Upstash (database hosting)
- Vercel (application hosting)
- Resend (transactional email)
- Mercury / Square (payments)
- Cal.com (calendar booking)
We do not sell your data. We do not share it with advertisers. We do not use customer conversation content for training third-party AI models.
Your customers' data
If you are a Delegate client, the customers your agent talks to are your contacts, not ours. You are the data controller; we are the processor. You are responsible for:
- Having a lawful basis to message your contacts (TCPA, CAN-SPAM, GDPR consent if applicable).
- Honoring opt-out requests (STOP keyword) — our platform enforces this automatically.
- Providing your customers with your own privacy policy disclosing AI-assisted communications.
Data retention
We retain conversation and account data for the lifetime of your account plus 24 months after termination, for legal and compliance purposes. You can request earlier deletion of specific records at any time, subject to regulatory requirements.
Your rights
You have the right to:
- Access the data we hold about you.
- Request correction of inaccurate data.
- Request deletion (subject to retention obligations).
- Export your data in a machine-readable format (available via your dashboard or by contacting us).
- Opt out of marketing communications.

Security
We use industry-standard encryption in transit (TLS 1.2+) and at rest. Access to production systems is limited to authorized personnel and protected by multi-factor authentication. We are not currently SOC 2 certified — Enterprise customers requiring formal compliance certifications should inquire about our roadmap.
Children
Delegate is not directed at and does not knowingly collect data from children under 13. If we discover such data, we delete it.
International users
Delegate is operated from the United States. By using the service, you consent to processing of your data in the US.
Changes
We may update this policy. Material changes will be communicated via email at least 30 days before taking effect.
